Terms of Use

You are responsible for all content you contribute to any NSW SES Online Services, including text, comments, photos, videos, audio and links (Your Content).

By contributing content to any NSW SES Online Service, you grant the NSW SES a royalty-free, non-exclusive, irrevocable, transferable, perpetual licence (including the right of sub-license) to use, reproduce, modify, adapt, develop, maintain and exploit Your Content in any form or on any medium. This may include the use of your photos or video on NSW SES web and/or social media platforms, transmission of the material by our Australian content partners. You retain copyright and any other rights you hold in Your Content and can continue to share and commercialise Your Content as you wish.

You warrant you own or have the right to use any copyright material included in Your Content (including music, photos, quotes and excerpts of audio or video), that you have permission of anyone appearing or performing in Your Content and that you are not infringing any person’s rights by submitting the content to the NSW SES. You also confirm you have, where appropriate, sought the consent of the parent or guardian of any person under the age of 18 who is featured in Your Content.

Please ensure you keep your own copies of Your Content as the NSW SES may not archive, store or back-up Your Content nor continue to make Your Content accessible online.

We reserve the right to, for any reason, review, edit, move or delete any content or material displayed on or through the NSW SES Online Services at any time without notice and without liability. While we make all reasonable efforts to ensure that all material that is contributed by NSW SES is correct, accuracy cannot be guaranteed and we do not assume any responsibility for the accuracy, completeness or authenticity of any information contained on the site or the NSW SES Online Services generally.

You also consent to NSW SES (and our successors, assigns and licensees) using or exercising its rights in Your Content, even if the use may otherwise be an infringement of your moral rights (as defined in the Australian Copyright Act 1968 (Cth) and equivalent legislation in other jurisdictions). Without limiting this consent, the NSW SES will endeavour to provide you with an appropriate credit when using Your Content on NSW SES platforms, though you understand and agree this may not always be possible.

While encouraging constructive debate and the sharing of diverse opinions, the NSW SES expects community members to treat each other with respect and courtesy. These standards apply to interaction within all NSW SES Online Services including official NSW SES accounts established on third-party social media sites.

Social Media Community Guidelines

NSW State Emergency Service (NSW SES) encourage contributions on our social media channels. Members expect a place that is respectful, reliable, relevant and safe.

We may edit or delete posts or comments that moderators consider to be:

• Abusive, offensive, misleading or unlawful - harassment or provoking other community members, swearing, derogatory language, deliberate misinformation and expression of views that are racist, sexist, homophobic or sexually explicit are not acceptable. Defamatory comments or posts that violate laws regarding privacy will be removed.
• Political in nature - these are forums to discuss policies and initiatives, not political parties and personalities.
• An infringement of intellectual property rights (including copyright) - members should only share third party content when they have consent to do so.
• Inappropriate, off topic, repetitive or vexatious - For example, the NSW SES reserves the right to reject contributions that have been widely canvassed in the forum. It also reserves the right to reject contributions from participants who seek to dominate the discussion.
• Deliberate provocation of other community members.
• Spam - we do not accept advertisements, requests to endorse commercial products or services or to solicit donations.

• A violation of the social media platform's terms and conditions.
• Impersonating someone else and/or posting on behalf of a suspended member.
• Seeking to directly solicit donations.
• Seeking to endorse commercial products or services.
• misinformation or misleading or false information

If you breach these guidelines, we may block your account or posts.  Please contact us if you think we have made a mistake and we’ll aim to respond to you as quickly as we can.

Please note that our social media channels are not monitored 24/7.

On our social media channels, we are not responsible for posts, comments or other content which contain:

• the views of others
• advertising
• links to other websites or social media platforms.

The views contained in comments on our channels are the author’s responsibility and should not be taken to represent the views of, or be endorsed by, the New South Wales State Emergency Service. We do not warrant that the information in these comments is current, complete, accurate or reliable.  To the maximum extent permitted by law, we disclaim all liability for any liability, loss, damage or cost arising from relying on any information in these comments or posts.

The NSW SES values the role of its communities in guiding content standards and etiquette among members. If you have concerns about inappropriate content on an NSW SES Online Service you can alert the moderator of that space.

When accessing or participating in a NSW SES - managed space on a third party platform, such as channels, pages or feeds hosted on an external site, you agree to comply with the terms and conditions specified by that third party platform.

The NSW SES recommends you make sure you understand the privacy settings for each platform with which you engage and choose appropriate options to protect your personal details and content shared.

Unless specifically noted in the House Rules for a particular service or in the Copyright notice, you may not otherwise use, reproduce, republish, modify, adapt, translate, prepare derivative works from, reverse engineer or disassemble NSW SES Content or the NSW Software, without obtaining the NSW SES's prior written permission.  

• You agree not to remove, obscure, or alter any NSW SES copyright notice or trademark on any content you access and use.
• You also agree not to use NSW SES Content in a way that implies endorsement by the NSW SES or any person included in the materials.

To the maximum extent permitted by law, NSW SES and any of its directors, officers, employees and agents exclude all liability for any loss or damage (including, without limitation, direct, indirect, special or consequential loss, loss of profits, loss or corruption of data, loss of anticipated savings, loss of goodwill or loss of opportunity) which you suffer whether arising under contract, tort (including negligence), equity, statute or any other cause of action, or otherwise as a result of using the NSW SES Online Services or any content, information or service available on or from the NSW SES Online Services.

These terms of use are governed by the laws of the State of New South Wales and you irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

Although Australian websites may be accessed outside of Australia, we make no representation that the content of the NSW SES Online Services complies with the laws of any other country. If you access the NSW SES Online Services from outside Australia, you are solely responsible for ensuring compliance with your local laws and for any reliance on NSW SES Online Services content.

If any provision of these terms is found to be invalid or unenforceable, the provision will be deemed severed from the terms and the remainder of the terms will continue in full force and effect.

Third Party Terms of Use

As well as publishing our own original content, the [Emergency Services Agency / Other Partner] also displays content from third parties. The following third parties require us to give notice of their terms to persons using their product(s) or data on our web page and a link to these terms is set out below (“Third Party Terms”). For clarity, in addition to our terms of use, you must comply with these Third Party Terms. HazardWatch Web App

The State of New South Wales (acting through the NSW Department of Customer Service (DCS)) makes the HazardWatch Web App available for use by the public. The HazardWatch Web App enables a user to receive warnings and information concerning current or imminent flood, fire or such other hazards about which the Web App provides warnings and information from time to time at locations which are listed and/or displayed on a map.
